General terms and conditions

Below follows the contract document that shall govern the purchase of products via the website www.conservasdanionline.es / online@dani.es, which belongs to DANI ON LINE, S.L. (Sole Proprietorship) (hereinafter the supplier).  The acceptance of this document implies that the user:

  1. Has read and understood what is stated herein.
  2. That they are a person who is legally competent to enter into a contract.
  3. That they assume all of the obligations set forth herein.

These terms and conditions shall be valid for an indefinite period and shall be applicable to all purchases made via the supplier’s website: www.conservasdanionline.es / online@dani.es.

The supplier reserves the right to unilaterally change these Terms and Conditions, without this affecting any goods or promotions acquired prior to the change.

If the user does not agree to these General Terms and Conditions, they must leave the website and may not obtain or use the products it offers.

The website www.conservasdanionline.es / online@dani.es has been developed for the benefit of end consumers, so the products that can be obtained on it are not aimed at wholesalers, distributors,  purchasing centres, large retail outlets or any professional intermediaries from the food sector and related industries.

IDENTITY OF THE PARTIES

As party of the first part, the supplier of the goods being purchased by the user is DANI ON LINE S.L. (Sole Proprietorship), with its registered address in the “Els Garrofers” Industrial Estate, sites 32-35-37 in Vilassur de Mar (Barcelona), Tax I.D. B-61368221, registered in the Companies Register of Barcelona, volume 29,844, folio 52, page B-162769, and with the email address online@dani.es, and, as party of the second part,

The user, registered on the website with a username and password, for whose use and safekeeping they are responsible, in addition to being responsible for the truthfulness of the personal data provided to the supplier.

“Users” shall be deemed to be those individuals who are consumers, end consumers, residents on the Spanish peninsular and Balearic Islands (i.e. excluding the Canary Islands, Ceuta and Melilla) or in the territory of another Member State of the European Union and who are of legal age.

It is therefore expressly forbidden for products to be purchased by minors, users who live in the Canary Islands, Ceuta or Melilla and users who live outside the European Union.

PURPOSE OF THE CONTRACT

The purpose of this contract is to govern the sale and purchase agreement established between the supplier and the user when the latter ticks the relevant checkbox during the purchasing process.

The sale and purchase agreement entails the delivery of a specific product in exchange for a specific price that is publicly displayed on the website.

PURCHASING PROCEDURE

The purchasing procedure shall be performed in Spanish. Should it be possible in another language, this shall be indicated before commencing the purchasing procedure.

To be able to obtain the products offered by the supplier, the user must register on the website by creating a user account. To do this, the user must freely and voluntarily provide the personal data requested of them.

The user shall select their username and password, and hereby undertakes to use them diligently and not to share them with third parties, and to inform the supplier of any loss or theft thereof or any possible unauthorised access by third parties, so that the supplier may block them immediately.

The user may not choose a username that is intended to confuse others by identifying them as an integral part of the supplier’s company, or use other expressions that are offensive, slanderous or generally contrary to law or are immoral or indecent.

Having created the user account, pursuant to the provisions of Information Society Services and Electronic Commerce Act 34/2002, you are hereby informed that the purchasing procedure shall follow these steps:

  1. Selection of the product
  2. Payment for the product
  3. Shipping of the product
  4. Return of the product

 

These processes shall be governed by the provisions of the respective section of this website.

In any event, once the purchasing procedure has been completed, the supplier’s purchasing platform shall inform the user by email of all of the characteristics; the price, transportation methods, date purchased and an estimated delivery date for the product that has been purchased.

APPLICABLE LAW AND JURISDICTION

These General Terms and Conditions are subject to the provisions of:

  • General Purchase Conditions Act 7/1998, of 13th April.
  • General Consumer Protection Act 26/1984, of 19th July.
  • Royal Decree 1906/1999, of 17th December 1999, governing Telephone or Electronic Contracting with general terms and conditions.
  • Data Protection Act 15/1999, of 13th December.
  • Retail Trade Regulations Act 7/1996 of 15th January.
  • Information Society Services and Electronic Commerce Act 34/2002, of 11th July.

The above legislation shall only prevail in the case of purchases made from within the Spanish territory (peninsula and Balearic Islands).

The supplier and the user hereby accept that for any dispute that may arise from the provision of the products that are the subject of these Terms and Conditions, they shall submit to the authority of the Courts where the user resides.

Should the user reside outside Spain, the supplier and the user shall expressly waive any other jurisdiction, and shall submit to the authority of the Courts of the city of Barcelona (Spain).
